Firm Defends Availability of Class Action under California Wage-and-Hour Law

Daniel B. Edelman, head of the Firm’s appellate practice group, prepared a brief filed with the U.S. Court of Appeals for the Ninth Circuit in a class action brought by two truck drivers against Dominos Pizza, seeking to hold it accountable for not allowing its drivers to take meal breaks as required by California law. The wage-and-hour lawsuit is captioned Espinoza v. Dominos Pizza, LLC, No. 09-80046 (9th Cir.) The brief opposes Dominos’ petition for review of the federal district court’s decision allowing the case to proceed as a class action. Mr. Edelman joined in filing the brief with Michael Malk, Esq., of Los Angeles and Barry L. Goldstein of Goldstein, Demchak, Baller, Borgen and Dardarian, the premier employment class action firm based in Oakland, California.
