Avi Kumin Weighs in on IBM Discrimination Allegations

Senior partner Avi Kumin was recently quoted in the SHRM article, “IBM Defends Itself from Allegations of Age Bias.”

A recent lawsuit against IBM alleges that the company is intentionally discriminating against older employees, including making comments that refer to them as “dinobabies” who need to be extinct. But experts note that while ageist comments can be direct evidence of age discrimination, they typically must be made in conjunction with an adverse employment action. One example, as Mr. Kumin notes, is in recruitment.

“A company is required to base its staffing on the qualifications of the employee – not the employee’s age,” Mr. Kumin said.
