Katz, Marshall & Banks senior counsel Carolyn Wheeler was recently quoted in the Law360 article, “7th Circ. Church Harassment Ruling Leaves Law Murky.”
In its decision regarding Sandor Demkovich v. St. Andrew the Apostle Parish, Calumet City, the 7th Circuit ruled that the “ministerial exception” to anti-discrimination laws shields religious employers from certain harassment claims. The ruling signifies a deepening rift in interpretation of the rule, and dissenters argue that it misinterprets Supreme Court precedent.
“As the dissent said, the majority made it seem like the Supreme Court already decided this, but it certainly didn’t,” Ms. Wheeler said.
