As more states loosen COVID-19 restrictions and allow businesses to reopen, it is important that employers balance their duty to protect their employees from COVID-19 with their obligations to their employees under federal anti-discrimination legislation.
Ms. Westerman advises employers on how to take precautions, such as conducting temperature checks, while still complying with the Americans with Disabilities Act, the Age Discrimination in Employment Act, Title VII of the Civil Rights Act, and other corresponding state laws.
Employers will have difficult decisions to make in the coming months, as even those businesses with the best intentions can inadvertently discriminate against an employee. The best way to avoid any personnel issues is to be informed and prepared.
