Katz, Marshall & Banks partners Lisa Banks and Michael Filoromo released the 2021 editions of the SEC and CFTC Whistleblower Practice Guides. The guides are comprehensive resources for whistleblowers and attorneys on how to navigate the SEC and CFTC Whistleblower Programs and qualify for monetary awards.
Among other updates, the 2021 edition of the SEC Whistleblower Practice Guide explains the Final Rules that the SEC adopted in September 2020, including a new presumption of the maximum 30% award in certain cases, an update to the definition of “whistleblower,” and more. It also highlights new and interesting circumstances around certain awards granted this past year, and incorporates an updated list of SEC whistleblower awards through March 31, 2021, including the largest-ever award issued to date.
The revised CFTC Whistleblower Practice Guide details the program’s tremendous growth over the past few years, and gives examples of the types of actions taken by the CFTC in 2020, including a joint action with thirty state regulators. Additionally, the guide includes a table of CFTC awards through March 31, 2021.
