Katz, Marshall & Banks partners Lisa Banks and Michael Filoromo released the 2020 editions of the SEC and CFTC Whistleblower Practice Guides. The guides are comprehensive resources for whistleblowers and attorneys on how to navigate the SEC and CFTC Whistleblower Programs and qualify for monetary awards.
Among other updates, the 2020 edition of the SEC Whistleblower Practice Guide covers a bill in Congress that would provide anti-retaliation protections to whistleblowers who report securities violations only internally rather than to the SEC – essentially reversing the Supreme Court’s decision in Digital Realty. The guide also describes the SEC’s first-ever award to a whistleblower whose internal reporting prompted a company to self-report to the SEC.
The revised CFTC Whistleblower Practice Guide details how the program’s tremendous growth over the past few years – in both the number of tips and the amount of money awarded – as well as an in-depth look at the effect of new rules the agency implemented in 2017.
