Katz, Marshall & Banks partner Michael Filoromo was interviewed on Philadelphia radio, WHYY, for a segment broadcast during National Public Radio’s “All Things Considered” about age discrimination complaints filed against Philadelphia’s District Attorney, Larry Krasner.
Mr. Filoromo noted that age discrimination claims are often difficult to prove, and that the Supreme Court has held that age claims are subject to a higher causation standard than many other federal discrimination claims. He noted that Krasner was elected D.A. with a mission to drastically reform the office, and therefore staff turnover was very likely. While the employees can point to the departure of other employees over 40, each employee will have to show that age was the reason for his or her termination.
