Previous Statement by Debra Katz Circulates Amid Report that Cuomo’s Attorney Will Resign

Katz, Marshall & Banks senior partner Debra Katz has been quoted by multiple news outlets regarding reports that Judith L. Mogul, special counsel to Andrew Cuomo and a key figure in the state attorney general’s investigation of the governor, will resign.

Ms. Mogul has been accused by KMB client Charlotte Bennett of mishandling allegations of sexual misconduct against Gov. Cuomo dating back to June 2020. Ms. Bennett says she detailed her allegations at the time to Ms. Mogul and Cuomo’s chief of staff Jill DesRosiers in a two-hour interview, but that no further actions were taken.

In an April 2021 statement, Ms. Katz previously said that DesRosiers and Mogul “fostered a toxic culture of enablement and abuse" that enabled Gov. Cuomo’s actions against Ms. Bennett. She further called their failure to forward Ms. Bennett’s allegations to the Government Office of Employee Relations a “clear derogation of their legal duties.”
